Consider recommendations relating to grant funding for the Drug Court Partnership and Comprehensive Drug Court
Implementation.
Possible action:
a. Approve delegation of authority to Director, Department of Alcohol and Drug Services,
or designee, to execute notice of grant award from the State Department of Health
Services relating to the Drug Court Partnership in an amount not to exceed $425,175 for
period commencing upon execution of grant award through June 30, 2006, and to
execute any necessary related documents including annual renewals through June 30,
2010, following approval by County Counsel as to form and legality, and approval by
the Office of the County Executive. Delegation of authority shall expire on June 30,
2010.
b. Approve delegation of authority to Director, Department of Alcohol and Drug Services,
or designee, to execute notice of grant award from the State Department of Health
Services relating to the Comprehensive Drug Court Implementation in an amount not to
exceed $445,275 for period commencing upon execution of grant award through
December 28, 2006, and to execute any necessary related documents including annual
renewals through December 28, 2010, following approval by County Counsel as to form
and legality, and approval by the Office of the County Executive. Delegation of
authority shall expire on December 28, 2010.
FISCAL IMPLICATIONS
There is no impact to the General Fund as a result of these actions. Funds have been recognized in the FY 2005/2006
Department of Alcohol and Drug Services budget.
CONTRACT HISTORY
The Department was first awarded the Drug Court Partnership(DCP)grant funding from the California Department of
Alcohol and Drug Programs(ADP)in collaboration with the California Judicial Council in May 1999. The initial grant
of $400,000 was for a four-year period, to expand and enhance services of the County's Adult Drug Treatment Court.
DADS was first awarded Comprehensive Drug Court Implementation(CDCI)funding in FY 01, receiving a notice of
grant award in March 2001 to expand services and support to substance abusing high risk criminal justice referrals from
the drug courts.

REASONS FOR RECOMMENDATION
The Drug Court Partnership and Comprehensive Drug Court Implementation grants are funded through the State
Department of Alcohol and Drug Programs and have been renewed annually. These grants are considered on-going.
Approval of the delegation of authority to execute notices of grant award and any necessary related documents including
annual renewals will allow for timely receipt of funds and continued reimbursement for services provided by the
Department.
In the event there is an increase in grant funding, the Department would present a spending plan to the full Board for
approval.
BACKGROUND
The Drug Court Partnership grant, first awarded in May 1999, supports Drug Treatment Court(DTC)activities such as a
drug court coordinator and community workers, in addition to treatment-related services such as transitional housing
unit beds for clients in substance abuse treatment. Partnerships of this grant include the Superior Court, DADS,the
District Attorney's Office, Office of Probation, the Public Defender, Mental Health Department, as well as a host of
public and private agencies.
The Comprehensive Drug Court Implementation (CDCI) grant is designed to enhance the operations of Drug Treatment
Courts such as Santa Clara County's program. The County's Drug Treatment Court(DTC) has experienced tremendous
growth since its inception in 1995, including a tripling of its original caseload. All DTC participants have been convicted
and have voluntarily chosen to participate in the year-long program. All of the participants are hard core addicts and a
significant percentage are pregnant or mothers with small children. All participants are supervised by the Probation
Department. DADS was first awarded CDCI funding in FY 2001, receiving a notice of grant award in March 2001 to
expand services and support to substance abusing high risk criminal justice referrals from the drug courts.
Through an oversight, the Department neglected to obtain a delegation of authority from the Board prior to signing to
accept the previous grant awards. The recommended actions will correct that oversight for the current grant period.
CONSEQUENCES OF NEGATIVE ACTION
The Department may not be able to receive and utilize the funding from the grants, and may not be able to receive
reimbursement for services provided by the Department.
