a. Approve delegation of authority to the Director of the Department of Alcohol and Drug
Services, or designee, to negotiate, execute and amend memorandums of understanding
with Superior Court relating to drug court reimbursement for criminal justice system
activities which are being funded through the Drug Court Partnership, Comprehensive
Drug Court Implementation, Comprehensive Drug Court Implementation Dependency
Drug Treatment Court and Substance Abuse and Mental Health Services Administration
grants for period Fiscal Year 2006, following approval by County Counsel as to form
and legality, and approval by the Office of the County Executive. Delegation of
authority shall expire on June 30, 2006.
b. Approve delegation of authority to the Director of Alcohol and Drug Services, or
designee, to renew the memorandums of understanding annually related to Dmg Court
Partnership and Comprehensive Drug Court Implementation for up to four additional
one-year terms, amend and terminate the memorandums of understanding, following
approval by County Counsel as to form and legality, and approval by the Office of the
County Executive. Delegation of Authority shall expire on June 30, 2010.
FISCAL IMPLICATIONS
There is no impact to the General Fund as a result of this action. Funding for reimbursement of services provided by the
Superior Court is included in the FY06 budget.
CONTRACT HISTORY
Since 1999, the Department of Alcohol and Drug Services(DADS)has worked with Superior Court in a coordinated
effort to provide assessment, treatment and referral services to clients in the criminal justice system. No formal written
agreement is in place defining the responsibilities of each party and enabling DADS to reimburse the Superior Court for
criminal justice system activities associated with these grants.
REASONS FOR RECOMMENDATION
DADS has been involved in a collaborative relationship with Superior Court since 1999 to provide services to clients
involved in the criminal justice system. All of the participants are hard core addicts, including pregnant women or
mothers with small children.
The Drug Court Partnership, Comprehensive Drug Court Implementation, Comprehensive Drug Court Implementation
Dependency Drug Treatment Court, and Substance Abuse and Mental Health Services Administration grants were
awarded to DADS to provide services to clients involved in the dmg treatment courts. Each of these four grants contain
funding to support drag court activities. DADS fiscally and programmatically administers the grants and reimburses the
Superior Court for such activities. The Background section contains a description of these activities.

related to each of these four grants will provide for a formal arrangement regarding responsibilities and reimbursement
for activities.
The Drug Court Partnership and Comprehensive Drug Court Implementation grants are funded through the State
Department of Alcohol and Drug Program and have been renewed annually. These grants are considered on-going.
Approval of the delegation of authority to renew the memorandums of understanding with Superior Court related to
these two grants would allow for timely renewal of the MOUs and also eliminate the need for repeated Board action
each year.
BACKGROUND
The Drug Court Partnership(DCP)grant funds are used to support drug treatment court activities such as funding a Drug
Treatment Court coordinator and ancillary services such as drug testing and bus passes. This grant also provides 13
transitional housing unit beds for clients that are in outpatient treatment.
The Comprehensive Drug Court Implementation (CDCI) grant supports personnel expense for data entry in the Superior
Court. In addition, the grant provides for psychiatric services, medication and residential and outpatient treatment
services for substance abusing high risk criminal justice clients.
The DCP and CDCI grants are funded through the State Department of Alcohol and Drug Program (ADP)and renewed
annually. The DCP grant was initially awarded to DADS in FY 99 and the CDCI grant was awarded to DADS in FY 01.
The Comprehensive Drug Court Implementation Dependency Drug Treatment Court(CDCI-DDTC)grant provides
enhanced services to clients in the dependency drug court with the goal of increasing family reunifications. This funding
provides dual diagnosed therapeutic services; case management and assistance in finding permanent housing for adults;
child advocate services and part-time psychotherapist services through the Dependency Drug Court. These services are
critical as client transitions out of the DDTC program involvement.
The CDCI-DDTC grant was awarded by ADP in November 2004 to provide enhanced services for Dependency Drug
Treatment Court participants for the period December 29, 2004 through December 28, 2005. The State has indicated that
this grant will continue through at least June 30, 2006.
The Substance Abuse and Mental Health Services Administration(SAMHSA)grant supports a Dual Diagnosis Drug
Court. DADS staff provides the dual diagnosis assessment necessary to refer clients into treatment. Participants of this
program receive psychiatric services through the Court, medication for stabilization, residential treatment, and intensive
outpatient treatment services. This is a three-year federally funded grant due to expire May 31, 2006.
CONSEQUENCES OF NEGATIVE ACTION
Failure to approve the recommended actions may delay DADS in reimbursing Superior Court for services provided.
