MONDAY, MAY 7, 1979
The Board of Supervisors of the County of Santa Clara convenes this day in
adjourned session in the chambers of the Board, 70 west Bedding Street, san Jose, at
7:10 a.m., with the following members presents
Chairperson Pro Tempore Dan
McCorquodale, Rod Diridon, Geraldine F. Steinberg, Susanne Wilson, and Gary F. Voecks,
Assistant Clerk, for Donald M. Rains, Clerk,
chairperson Dominic L. Cortese is
absent on County business.
The meeting is called to order and the following proceedings are had to wit:
The Chairperson Pro Tempore requests the County Executive read a proposed
resolution, received from the state, which would declare a local emergency exists in
regard to the gasoline shortage, thereby allowing the County to participate in the
Gasoline Management Plan of the state.
On motion of Supervisor Wilson, seconded by Supervisor Diridon, it is unanimously
ordered on roll call vote that a resolution be adopted as follows:
RESOLUTION OF THE BOARD OF SUPERVISORS OF THE
COUNTY OF SANTA CLARA, STATE OF CALIFORNIA,
DECLARING A LOCAL EMERGENCY AND REQUESTING
THE GOVERNOR TO ISSUE ORDERS AND REGULATIONS
WHEREAS, gasoline has become increasingly in short supply in the County of
Santa Clara, local gasoline retailers having received allocation cutbacks and therefore
reducing service hours, and such limited supplies creating long lines at local
gasoline stations and causing traffic congestion and other related problems; and
WHEREAS, such facts require the implementation of a mandatory gasoline marketing
plan to provide relief from this emergency situation;
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of
Santa Clara, State of California, that:
(a) This Board hereby declares a state of local emergency within the territorial
limits of the County of Santa Clara, such emergency existing by virtue of the fact
that gasoline has become increasingly in short supply in the county of Santa Clara,
local gasoline retailers having received allocation cutbacks and therefore reducing
service hours, and such limited supplies creating long lines at local gasoline
stations and causing traffic congestion and other related problems; and
(b)
This Board hereby requests the Governor of the State of California, pursuant
to the authority granted by section B567 of the Government Code of the State of
California, to issue the necessary orders and regulations p>ertaining to the California
gasoline emergency and governing and restricting the purchase of gasoline; and
(c)
This Board hereby requests the Governor to implement such orders and
regulations within the territorial limits of the County of Santa Clara so that such
orders and regulations are applicable thereto.

'BE IT FURTHER RESOLVED that the Clerk of the Board of Supervisors is hereby
directed to furnish copies of this resolution to the Governor of the State of California,
to the State Office of Emergency Services, and to all cities located within the county
of Santa Clara.

Supervisor Wilson initiates discussion on the problem of the three-day Memorial
weekend, coming up. She,suggests a plan be recommended to the Governor whereby some
areas of the State would celebrate the weekend on May 26, 27 and 28, and other areas
would celebrate on June 2, 3 and 4.
Discussion follows.
On motion of Supervisor Wilson, seconded by Supervisor Diridon, it is unanimously
agreed to refer to the Governor a suggested amendment to the Operational Plan that
would have some counties celebrating Memorial Day on May 26, 27 and 28, and other
Counties observing the holiday on June. 2, 3 and 4.
Supervisor Steinberg indicates that any suggestions to the plan- alleviate the
problem only temporarily since allocation is the real problem. Supervisor Diridon
suggests the Board simply recoirenend that people do not plan any trips for the Memorial
Day weekend as that is the way to save energy. It is agreed that whatever is done
now is a means to solve the immediate problem only, but there are very important
long range problems which must be considered in dealing with the shortage of energy
supplies. Supervisor Diridon indicates that in line with recommendations from the
Energy Task Force various ordinances are forthcoming which will deal with the mandating
of energy-saving devices, and the Board will be considering these soon.
Paul R. Hay, Executive Director of the Santa Clara County Service Station Dealers
Association, is present. Upon questioning from Supervisor Steinberg, he indicates
that in order to possibly forestall the proposed four-day shutdown, the Board could
adopt a resolution asking the President, Governor Brown, James Schlesinger and
David Bardin, with the Economic Regulatory Administration, to provide, dealers with a
fair and reasonable profit margin and pass regulations which are clearly understandable.
There is discussion as to what constitutes a fair and reasonable margin and whether
the regulations are enforceable. Supervisor Wilson indicates she will be meeting
May 13 at 4:00 p.m. with members of the Service Station Dealers Association to discuss

On motion of Supervisor Steinberg, seconded by Supervisor Diridon, it is unani
mously ordered that County Counsel be requested to prepare a resolution urging that
profit margins be evaluated in relation to gasoline sales and that fair and equitable
margins be established.
It is further ordered that understandable and enforceable
regulations be adopted by the government, with the understanding that there is a time
problem, and that an immediate answer be requested in order to possibly forego the
proposed four-day closure of gasoline stations.

Mr. Hay requests that there be some clarification on portions of the proposed
operational plan, one being doctors' vehicles, which he recommends be totally exempt.
Individual Board members feel this may be going too far as doctors have recreational
vehicles and are not always on duty and in need of gas any more than other members of
the public.
The question of emergency vehicles being allowed to come to the head of
the line is discussed, and it is felt that this should be allowed whether or not the
regulations so state.
Mr. Hay indicates that flags and signs have been ordered,
telephones are being set up for hot line purposes, and newsletters are also being
prepared.
James Graebner, Transportation Agency Director, gives a brief report on the
marked increase in transit passengers, and the Board points out that Southern Pacific
passenger counts are also showing a marked increase.
There being no further business, the meeting is adjourned at 7:55 a.m.
